These Terms & Conditions apply to all transportation and chauffeur services booked with, arranged by, or provided through Black Grandeur Chauffeur ("BGC", "we", "us" or "our"), regardless of the city, state, territory, region or country in which the service is provided, unless different terms are expressly agreed in writing for a particular booking.
These Terms apply to bookings made through our website, application, telephone, email, payment link, authorised agent, affiliate, partner or other approved booking channel.
Where Black Grandeur Chauffeur arranges a service through an authorised affiliate operator, partner chauffeur or subcontracted transportation provider, these Terms & Conditions continue to apply to the customer's booking with Black Grandeur Chauffeur, subject to any mandatory laws, regulations or local requirements applicable where the service is performed.
By confirming a booking and/or making payment, the customer acknowledges and accepts these Terms & Conditions.
These Terms should be read together with the quotation, booking confirmation and any booking-specific conditions communicated to the customer in writing.
Where a booking-specific condition expressly differs from these general Terms & Conditions, the booking-specific condition will apply to that booking to the extent of the difference, subject to applicable law.
1. BOOKINGS & CONFIRMATION
A booking is considered confirmed once Black Grandeur Chauffeur has accepted the booking and issued a booking confirmation.
Customers are responsible for checking their confirmation and ensuring all information is correct, including:
- Passenger name and contact number
- Pickup date and time
- Pickup location
- Destination
- Service type
- Vehicle category
- Number of passengers
- Luggage requirements
- Flight details
- Additional stops
- Child-restraint requirements
- Any other special requirements
Any incorrect information or requested change should be reported to us as soon as possible.
Changes requested after confirmation are subject to availability and may affect the price.
A requested amendment is not confirmed until it has been accepted by Black Grandeur Chauffeur.
2. FARES, SERVICE TYPES & CORRECT BOOKING CATEGORY
All prices are quoted in the applicable currency advised at the time of booking.
Pricing is based on the actual type and requirements of the service being provided, not simply the booking option selected by the customer online.
Different prices and conditions may apply to:
- Standard Point-to-Point Transfers
- Airport Transfers
- Weddings
- School Formals and School Events
- Special Events
- Concerts and Major Events
- Hourly / As-Directed Hire
- Corporate Transportation
- Group Transportation
- Other specialised transportation services
Point-to-Point Transfers
A standard Point-to-Point fare is intended for an ordinary direct transfer from one confirmed location to another.
A Point-to-Point booking must not be used to obtain a standard transfer price where the actual transportation is for a wedding, school formal, special event or another separately priced service category.
Weddings, School Formals & Events
Customers must disclose the actual purpose of the transportation when making a booking.
Where transportation relates to a wedding, wedding-related function, school formal, school event, concert, festival, sporting event, major event, corporate event, private function or other special event, the applicable special-service pricing may apply even where the customer initially selected Point-to-Point.
These services may have different pricing because they can require additional vehicle preparation, scheduling, chauffeur allocation, coordination, traffic planning, venue access management, waiting allowances or other operational requirements.
Incorrect Service Category Selected
If we identify before the service that the customer has selected an incorrect service category, we will advise the customer of the appropriate category and any applicable price difference.
The customer may accept the revised service and fare or cancel subject to the applicable cancellation conditions and any rights available under applicable consumer law.
Where reasonably practicable, we will advise the customer before applying a higher service-category fare.
If the true nature of the booking is only discovered during or after the service, Black Grandeur Chauffeur may seek the reasonable difference between the amount paid and the applicable service price where materially incorrect or incomplete information was provided when booking.
Selecting "Point-to-Point" online does not automatically make a journey eligible for Point-to-Point pricing where the actual service is a wedding, school formal, event or another separately priced service.
3. QUOTATIONS & FARES
The quoted or estimated fare is based on the information provided when the quotation or booking is made.
This may include:
- Pickup and destination
- Date and time
- Vehicle category
- Passenger numbers
- Luggage
- Service type
- Expected duration
- Confirmed stops
- Other disclosed requirements
Additional charges may apply where the customer subsequently requests or causes a material change to the agreed service.
This may include:
- Additional stops
- Additional waiting time
- Route changes
- Extended hire
- Additional kilometres where applicable
- Vehicle upgrades
- Additional services
- Cleaning
- Passenger-caused damage
Where reasonably practicable, the customer will be informed of applicable additional charges.
4. PAYMENT
Payment must be made according to the requirements stated on the quotation, invoice, payment request or booking confirmation.
A booking may require full payment, a deposit or valid payment details before confirmation.
Where a deposit is required, the booking may not be secured until the required payment has been received.
Any applicable payment surcharge will be disclosed where required.
A receipt or tax invoice can be provided upon request.
5. CANCELLATIONS & REFUNDS
Cancellation notice is calculated from the time the cancellation request is received by Black Grandeur Chauffeur.
Airport Transfers
A full refund is available where cancellation is received at least 24 hours before the scheduled pickup time.
Point-to-Point Transfers
A full refund is available where cancellation is received at least 24 hours before the scheduled pickup time.
Weddings
A full refund is available where cancellation is received at least 48 hours before the scheduled commencement time.
Events
A full refund is available where cancellation is received at least 48 hours before the scheduled commencement time.
School Formals & School Events
A full refund is available where cancellation is received at least 48 hours before the scheduled commencement time.
Where cancellation occurs inside the applicable notice period, a full refund is not guaranteed. Any cancellation amount retained or charged will be determined having regard to the booking conditions, reasonable costs associated with the cancellation and any rights the customer has under applicable consumer law.
6. REFUND PROCESSING
Approved refunds will ordinarily be returned to the original payment method.
Once Black Grandeur Chauffeur has processed a refund, the customer's bank or payment provider may require additional time for the funds to appear.
Bank and card-processing times are outside our direct control once a refund has been submitted.
7. COMPLIMENTARY GRACE PERIODS
The following complimentary waiting periods apply.
- Point-to-Point Transfers – 10 minutes from the confirmed pickup time.
- Domestic Airport Arrivals – 30 minutes from the flight's actual landing time, provided the correct flight number has been supplied.
- International Airport Arrivals – 70 minutes from the flight's actual landing time, provided the correct flight number has been supplied.
Once the applicable complimentary grace period expires, waiting-time charges may apply.
8. WAITING-TIME CHARGES
After the applicable complimentary grace period expires, waiting time is charged per minute according to the vehicle category:
- Luxury Sedan – $2 per minute
- Luxury SUV – $2 per minute
- First Class – $3 per minute
- Luxury Van – $3 per minute
- Sprinter Van – $4 per minute
- Sprinter Bus – $4 per minute
- Coach – $10 per minute
Waiting charges commence after the applicable complimentary grace period has expired.
Continued waiting is subject to chauffeur and vehicle availability.
A chauffeur cannot be guaranteed to wait indefinitely where the vehicle has another confirmed booking or where continuing to wait would create safety, fatigue, legal or operational issues.
9. AIRPORT TRANSFERS & FLIGHT MONITORING
Customers must provide the correct flight number for airport arrival bookings.
Where the correct flight number has been provided, Black Grandeur Chauffeur will make reasonable efforts to monitor the flight.
For domestic arrivals, the complimentary 30-minute grace period starts from the flight's actual landing time.
For international arrivals, the complimentary 70-minute grace period starts from the flight's actual landing time.
If a passenger changes flights, misses a connection or travels on a different flight, Black Grandeur Chauffeur must be notified as soon as reasonably possible.
Where no flight number, an incorrect flight number or materially incomplete flight information is provided, we may be unable to monitor the passenger's arrival.
Additional waiting, rescheduling or replacement transportation may result in additional charges where reasonably applicable.
10. NO-SHOWS
A booking may be treated as a no-show where:
- The applicable complimentary grace period has expired
- The passenger has not presented at the agreed pickup location
- Reasonable attempts have been made to contact the passenger using the details provided with the booking
- The passenger cannot reasonably be located or contacted
For airport pickups, the applicable domestic or international grace period will be observed before the booking is treated as a no-show where correct flight details were provided.
If a passenger cannot locate the chauffeur, the passenger should contact Black Grandeur Chauffeur before leaving the pickup location.
11. ADDITIONAL STOPS, DETOURS & ROUTE CHANGES
Point-to-Point pricing is based on the itinerary confirmed at the time of booking.
Any additional stop, unscheduled stop, detour or material route change requested by the passenger may result in additional charges based on the additional time and/or distance involved.
This includes stops for:
- Food or refreshments
- Shopping
- Collecting additional passengers
- Dropping off additional passengers
- Personal errands
- Other passenger-requested deviations
Where an additional stop requires the chauffeur to wait, additional waiting or service-time charges may apply.
Additional stops are subject to chauffeur and vehicle availability.
A chauffeur may be unable to accommodate an additional stop where doing so would materially interfere with another confirmed booking or create a safety, legal or operational issue.
12. HOURLY / AS-DIRECTED HIRE
Hourly bookings are subject to the minimum hire period confirmed at booking.
The hire period begins at the confirmed commencement time.
Passenger-requested waiting during an hourly booking forms part of the hire period.
Where the customer requests the service to continue beyond the agreed hire period, additional time may be charged at the applicable vehicle rate.
Extensions are subject to chauffeur and vehicle availability.
13. WEDDING SERVICES
Wedding transportation is a specialised service and may be separately priced from ordinary Point-to-Point transportation.
Customers must disclose that transportation is wedding-related when making the booking.
Wedding services may involve additional:
- Vehicle preparation
- Scheduling
- Chauffeur allocation
- Ceremony coordination
- Photography movements
- Waiting
- Multiple passenger movements
- Venue access requirements
Customers should provide an accurate itinerary before the service.
We will make reasonable efforts to accommodate reasonable delays; however, significant waiting, additional movements, additional stops or service extensions may incur additional charges.
14. SCHOOL FORMALS & SCHOOL EVENTS
School formal and school-event transportation may be separately priced from ordinary Point-to-Point transportation.
The purpose of the transportation must be disclosed when booking.
Customers must provide accurate passenger numbers, pickup information and itinerary details.
Changes, additional stops, extended waiting or service extensions may result in additional charges.
15. EVENTS & MAJOR EVENTS
Event transportation may be subject to separate Event or Major Event pricing.
Major events may involve:
- Road closures
- Police directions
- Traffic controllers
- Designated pickup and drop-off zones
- Heavy traffic congestion
- Venue access restrictions
- Significant delays
Black Grandeur Chauffeur and its chauffeurs cannot override lawful directions issued by police, traffic controllers, government authorities or venue management.
Where a chauffeur cannot legally or safely reach the requested pickup point, a reasonably nearby safe and lawful meeting location may be arranged.
Passengers must remain reasonably contactable during event pickups.
16. VEHICLE CATEGORY, MAKE, MODEL & COLOUR
Black Grandeur Chauffeur will make reasonable efforts to provide the confirmed vehicle category.
Unless a particular vehicle make, model, colour, registration or individual vehicle has been expressly guaranteed in writing, photographs and vehicle descriptions on our website, quotations or promotional material are representative of the relevant vehicle category.
Specific vehicle makes, models, model years, colours and registrations may vary.
If an allocated vehicle becomes unavailable due to mechanical problems, accident, maintenance, operational requirements or other unexpected circumstances, Black Grandeur Chauffeur may provide a reasonably comparable replacement vehicle.
Where practicable, the replacement will provide appropriate passenger capacity and a comparable level of service.
Where we cannot provide the confirmed service or a reasonable alternative, an appropriate remedy will be determined having regard to the circumstances, the service actually provided and applicable consumer law.
17. AFFILIATE OPERATORS, PARTNERS & SUBCONTRACTORS
Black Grandeur Chauffeur may use appropriately authorised affiliate operators, partner chauffeurs or subcontracted transportation providers to fulfil bookings.
This may occur because of location, availability, peak demand, operational requirements or other legitimate business reasons.
Use of an affiliate or subcontractor does not by itself mean that the customer's booking has been cancelled.
Reasonable efforts will be made to provide a vehicle and service consistent with the confirmed booking category.
These Terms & Conditions continue to apply to the customer's booking with Black Grandeur Chauffeur, subject to any mandatory local laws and requirements.
18. DRIVER & VEHICLE DETAILS
Driver and vehicle details may be supplied closer to the scheduled service once final allocation has been completed.
Driver and vehicle allocations may change due to operational circumstances.
Where our booking or dispatch system displays terms such as "Allocated", "Assigned", "Farmed Out" or similar operational statuses, these are internal booking/dispatch classifications and do not necessarily mean that the customer's booking has been cancelled or materially changed.
19. PASSENGER NUMBERS & LUGGAGE
Customers are responsible for providing accurate passenger and luggage information.
The number of passengers must not exceed the lawful seating capacity of the vehicle.
Luggage must be capable of being transported safely.
We may refuse to carry passengers or luggage where doing so would:
- Exceed legal vehicle capacity
- Interfere with seatbelt use
- Obstruct the chauffeur
- Exceed safe luggage capacity
- Create an unsafe condition
- Breach applicable transport requirements
Where materially incorrect passenger or luggage information results in the booked vehicle being unsuitable, an alternative vehicle may be required and additional charges may apply.
20. CHILD RESTRAINTS
Customers requiring a child restraint must request it when booking.
Child restraints are subject to availability and applicable legal requirements in the location where the service is provided.
Customers must provide accurate information regarding the child's requirements.
Where a customer provides their own child restraint, the customer is responsible for ensuring that it is appropriate and compatible with the vehicle.
Any concern regarding a child restraint should be raised with the chauffeur before departure so that it can be addressed.
21. FOOD, BEVERAGES & ALCOHOL
Food and beverages may only be consumed where permitted for the particular vehicle and service.
Where permission is given for passengers to bring or consume beverages, passengers remain responsible for preventing spills, staining and damage.
Permission to bring or consume food or beverages does not waive responsibility for cleaning or damage resulting from passenger conduct.
Alcohol may only be carried or consumed where lawful and permitted for the particular vehicle and service.
The chauffeur may restrict consumption where reasonably required for safety, legal or operational reasons.
22. CLEANING, SPILLS & EXCESSIVE SOILING
Passengers are expected to leave vehicles in a reasonably clean condition.
Additional cleaning charges may apply where cleaning beyond normal routine vehicle preparation is reasonably required because of passenger conduct.
This may include:
- Drink spills
- Food spills
- Vomit
- Bodily fluids
- Excessive mud or dirt
- Staining
- Excessive rubbish
- Confetti or similar materials
- Other significant contamination or soiling
Where a $300 cleaning or spill charge has been disclosed as part of the booking conditions, that charge may apply where the relevant spill or cleaning incident occurs.
For other incidents, the amount charged will be reasonable having regard to the nature and extent of the cleaning required, specialist cleaning costs and any reasonably documented vehicle downtime.
Black Grandeur Chauffeur may retain photographs, chauffeur reports, cleaning invoices or receipts and other reasonable evidence documenting the condition of the vehicle and cleaning required.
23. VEHICLE DAMAGE
Passengers may be responsible for damage they intentionally or negligently cause to a vehicle or its equipment.
Black Grandeur Chauffeur may seek reimbursement for reasonable repair, replacement and directly associated costs attributable to passenger-caused damage.
Photographs, repair quotations, invoices, chauffeur reports or other reasonable evidence may be retained.
Normal wear and tear is excluded.
24. SMOKING & VAPING
Smoking and vaping are prohibited inside vehicles.
Where smoking or vaping results in additional cleaning, deodorising, remediation or damage, reasonable associated costs may be charged.
25. PASSENGER CONDUCT & SAFETY
Passengers must behave appropriately and respectfully toward chauffeurs, staff and other passengers.
The following conduct is not permitted:
- Violence or threats of violence
- Serious verbal abuse or harassment
- Deliberate vehicle damage
- Illegal drug use
- Smoking or vaping inside the vehicle
- Interference with vehicle controls
- Conduct that seriously distracts the chauffeur
- Unlawful conduct
- Behaviour creating a material safety risk
A chauffeur may stop or terminate a journey where reasonably necessary to protect passengers, the chauffeur, the public or the vehicle.
Where reasonably possible, passengers will be given an opportunity to correct inappropriate behaviour before the service is terminated unless immediate action is reasonably necessary for safety.
Any refund following termination will depend on the circumstances, the portion of the service already provided and applicable consumer law.
26. SEATBELTS & LEGAL REQUIREMENTS
Passengers must comply with applicable seatbelt and passenger-safety requirements.
A chauffeur may decline to commence or continue a journey where doing so would be unlawful or unsafe.
27. UNSAFE OR INACCESSIBLE LOCATIONS
A chauffeur is not required to enter a road, driveway, property or location that the chauffeur reasonably considers unsafe, unlawful or unsuitable for the vehicle.
This may include:
- Flooded roads
- Unsuitable unsealed roads
- Narrow access
- Insufficient ground clearance
- Height restrictions
- Weight restrictions
- Unsafe turning areas
- Police-controlled areas
- Other material hazards
Where reasonably possible, an alternative nearby safe pickup or drop-off point will be arranged.
28. LOST PROPERTY
Passengers are responsible for their personal belongings.
Where an item is found, reasonable efforts will be made to identify and contact the owner.
Returning lost property may require a separate vehicle journey, courier or postage service.
Reasonable return or delivery costs may apply and will be communicated before return arrangements are finalised.
Chauffeurs and staff are not authorised to request personal payments or rewards from customers for returning lost property outside Black Grandeur Chauffeur's authorised process.
29. BREAKDOWNS, ACCIDENTS & VEHICLE UNAVAILABILITY
Unexpected breakdowns, accidents and operational disruptions may occur despite reasonable maintenance and planning.
Where an allocated vehicle becomes unavailable, Black Grandeur Chauffeur will make reasonable efforts to:
- Provide a replacement vehicle;
- Arrange suitable alternative transportation; or
- Provide an appropriate refund or other remedy where the service cannot reasonably be supplied.
The appropriate remedy will depend on the circumstances and the portion of the service successfully supplied.
Nothing in this section limits any rights or remedies that cannot lawfully be excluded.
30. TRAFFIC, ROAD CLOSURES & DELAYS OUTSIDE OUR REASONABLE CONTROL
Journey times may be affected by circumstances outside Black Grandeur Chauffeur's reasonable control, including:
- Traffic congestion
- Accidents
- Road closures
- Police directions
- Traffic-control restrictions
- Severe weather
- Natural disasters
- Flight disruptions
- Major events
- Venue restrictions
- Emergency situations
We will make reasonable efforts to minimise disruption and communicate material changes where practicable.
Customers travelling to flights, ceremonies, appointments or other time-sensitive commitments should allow an appropriate travel-time margin.
31. CUSTOMER-PROVIDED INFORMATION
Customers are responsible for providing materially accurate information when booking.
This includes:
- Date
- Pickup time
- Pickup address
- Destination
- Passenger name
- Contact number
- Flight number
- Passenger numbers
- Luggage
- Actual service purpose
- Special requirements
Where materially incorrect or incomplete information results in additional time, distance, waiting or operational costs, reasonable additional charges may apply.
32. BOOKING CHANGES & SERVICE EXTENSIONS
Customers may request changes to confirmed bookings.
Changes are subject to availability and may affect the fare.
A material change may require a revised quotation.
Where a customer requests the service to continue beyond the confirmed booking period, we will make reasonable efforts to accommodate the request.
Service extensions are subject to chauffeur and vehicle availability and may incur additional charges at the applicable rate.
33. COMPLAINTS
Customers should notify Black Grandeur Chauffeur of any concern as soon as reasonably possible.
Where an issue occurs during a service, customers are encouraged to contact our operations team while the service is underway where doing so may allow the matter to be resolved immediately.
When investigating a complaint, Black Grandeur Chauffeur may review relevant:
- Booking records
- GPS or service records
- Calls, emails and messages
- Chauffeur reports
- Photographs
- Payment records
- Other relevant service information
Complaints will be considered reasonably based on the circumstances and available evidence.
34. PAYMENT DISPUTES & CHARGEBACKS
Customers who believe a payment or additional charge is incorrect should contact Black Grandeur Chauffeur promptly so the matter can be investigated.
Nothing in these Terms prevents a customer from exercising any lawful rights through their bank, card issuer, payment provider or consumer-protection authority.
Where a payment dispute or chargeback is raised, Black Grandeur Chauffeur may provide relevant booking confirmations, communications, service records, GPS information, photographs, invoices, chauffeur reports and other legitimate evidence to the relevant financial or payment provider for the purpose of responding to the dispute.
35. PRIVACY & RECORDS
Customer information may be collected, used and retained for purposes reasonably connected with:
- Processing bookings
- Providing transportation services
- Passenger communication
- Processing payments
- Customer service
- Complaints
- Incident investigations
- Insurance matters
- Payment disputes and chargebacks
- Legal and regulatory requirements
- Maintaining appropriate business records
Personal information will be handled in accordance with applicable privacy requirements and our Privacy Policy where applicable.
36. CONSUMER RIGHTS
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified under applicable consumer-protection legislation.
Where the customer has a statutory entitlement to a refund, replacement service, compensation or another remedy, these Terms operate subject to that entitlement.
37. SERVICES PROVIDED IN DIFFERENT LOCATIONS
These Terms & Conditions are intended to apply wherever Black Grandeur Chauffeur provides or arranges a transportation service.
Individual services remain subject to mandatory transport regulations, consumer protections and other laws applicable in the jurisdiction where the service is provided.
Where a provision of these Terms conflicts with a mandatory law applying to a particular service, the mandatory law will prevail to the extent of that conflict.
The use of an affiliate, partner chauffeur or subcontracted operator in another location does not by itself prevent these Terms from applying to the customer's booking with Black Grandeur Chauffeur.
38. CHANGES TO THESE TERMS & CONDITIONS
Black Grandeur Chauffeur may update these Terms & Conditions from time to time.
The Terms applicable to an existing confirmed booking will generally be those provided or made available in connection with that booking, together with any subsequent variation expressly agreed with the customer.
An update to website Terms & Conditions will not retrospectively remove statutory rights.
39. GOVERNING LAW
Unless mandatory law requires otherwise, the contractual relationship between Black Grandeur Chauffeur and the customer is governed by the laws of Queensland, Australia.
Where services are provided in another jurisdiction, any mandatory laws applicable to that service continue to apply.
40. CONTACTING BLACK GRANDEUR CHAUFFEUR
Customers should contact Black Grandeur Chauffeur through our official customer-service channels regarding:
- Booking changes
- Cancellations
- Refunds
- Complaints
- Payment enquiries
- Additional charges
- Lost property
- Other booking-related matters
Customers should provide their booking reference whenever possible.
